The Conflict Minerals Regulation (EU) 2017/821 laying down supply chain due diligence obligations for Union importers

The Italian Legislative Decree related to this EU regulation, issued on the 2nd February 2021 n. 13, has been published now in the Italian Official Journal to achieve national compliance.

The Legislative Decree designates the Ministry of Economic Development as the Competent Authority for the effective and uniform application of the regulation and defines the necessary actions for the implementation of the referring activities.
The Authority will be in charge of the ex-post checks on the EU importers to verify the compliance to the obligations and provide corrective measures in case of infringement and eventual administrative sanctions.
The Competent Authority will be supported by a Committee composed by representatives of other ministries and public agencies.
The Authority will assure the coordination with the EU expert groups and at the European Commission and with other international organizations, in particular with the OECD. It will promote both communication and guidance, through initiatives for the adoption of due diligence along the entire supply chain, including the diffusion of tools and supporting measures provided by the European Union to raise the awareness of SMEs and all civil society around due diligence obligations and expectations.
